These terms apply to the OC United website at ocunited.org, operated by OC United Together, Inc., doing business as OC United ("OC United," "we," "us," or "our"), a 501(c)(3) nonprofit organization in Fullerton, California.

1. Acceptance of these terms

By using this website, you agree to these terms. If you do not agree, please do not use the site. We may update these terms from time to time, and continued use of the site after a change means you accept the updated version. The current version is always posted here with the date it was last updated.

2. About our services

This website provides information about OC United's programs and community work. Depending on the page, you may also be able to contact us, request support, register for an event, express interest in volunteering, or make a donation.

Information on this site is provided for general purposes. Participation in any OC United program is governed by the separate enrollment and consent paperwork you receive at intake, not by these terms.

3. Donations

Donations to OC United are voluntary. Unless we state otherwise at the time of the gift, donations are non-refundable.

If you believe a gift was made in error, was the wrong amount, or was duplicated, contact us at info@ocunited.org or 714-515-3085 and we will work with you to resolve it.

OC United issues tax receipts for charitable contributions. Our tax ID is 46-3761517.

Recurring gifts can be cancelled at any time through the EveryAction self-service link or by contacting us at info@ocunited.org or 714-515-3085.

Donations are processed through EveryAction, a Bonterra product. Your use of that platform is also subject to its own terms.

4. Event and program registration

Registering for an event or program through this site may require additional information, waivers, or paperwork, which will be provided at the time of registration.

Program participation itself is governed by the enrollment agreements and consent forms provided to participants and families, which take precedence over these terms.

5. Acceptable Uue

When using this site, you agree not to:
- Use it for any unlawful purpose
- Attempt to gain unauthorized access to any part of the site, our systems, or our data
- Scrape, harvest, or collect information about other users
- Submit content that is unlawful, threatening, harassing, defamatory, or infringing
- Interfere with the site's operation or security
- Impersonate any person or organization

6. Intellectual property

The OC United name, logo, photographs, written content, and design elements on this site are the property of OC United or are used with permission. You may not reproduce, distribute, or use them for commercial purposes without our written consent.

Sharing our content in the ordinary way — linking to a page, forwarding a newsletter, reposting on social media with attribution — is welcome and encouraged.

7. Content you submit to us

If you send us a story, photograph, testimonial, comment, or other content, you confirm that you have the right to share it, and you give OC United permission to use it in our communications.

We treat stories about the people we serve with particular care. Stories involving program participants are used publicly only with explicit permission from the people involved. If you have shared something with us and want it removed from public use, contact us at info@ocunited.org and we will take it down.

8. Third-party links and services

This site links to other organizations, partners, and resources, and uses third-party platforms for donations, forms, and registration. We are not responsible for the content, terms, or privacy practices of any site or service we do not operate.

9. Disclaimers

This website and its content are provided on an "as is" and "as available" basis. We work to keep information on this site accurate and current, but we make no warranties about its completeness, accuracy, or availability. Information on this site is not professional, legal, medical, or financial advice.

10. Limitation of liability

To the fullest extent permitted by applicable law, OC United Together (hereinafter, "OC United") and its directors, officers, employees, agents, volunteers, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of this website or any content, services, or materials made available through the website.

To the extent permitted by applicable law, the aggregate liability of OC United and its directors, officers, employees, agents, volunteers, affiliates, and service providers arising out of or relating to your use of, or inability to use, the website shall not exceed the amount you paid or donated, if any, to OC United in connection with your use of the website during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms of Use limits or excludes any liability that cannot lawfully be limited or excluded under applicable law, including liability for fraud, willful misconduct, or violations of law. Nothing in these Terms limits any rights or remedies that cannot be waived under applicable law.

11. Governing law

Text Messaging (SMS/MMS) Terms and Conditions

13. About our text messaging program

OC United Together, Inc., doing business as OC United ("OC United," "we," "us," or "our"), offers text (SMS and MMS) messaging so that our staff, program leads, and site leads can communicate directly with the people we serve and the people who support our work. Depending on which program you are involved with, messages may include:

- two-way conversations with a program lead, site lead, or case manager about services, scheduling, or how a participant's day went;
- program, camp, and event updates, reminders, and logistics;
- volunteer recruitment, scheduling, and coordination;
- donation receipts, acknowledgements, and giving reminders; and
- general organizational updates, such as newsletters and event invitations.

[DECISION NEEDED — Deanna/David: this list must match the campaign description and sample messages in the registration form exactly; reviewers compare the two. The last two bullets are promotional rather than conversational and are held to a higher consent standard. If you do not plan to send fundraising appeals or newsletter blasts by text, delete those bullets — approval will be easier.]

14. How you sign up

You can sign up to receive text messages from us in any of these ways:
- by entering your mobile number and checking the text message consent box on a form on our website, including our Contact Us form;
- by giving your mobile number to an OC United staff member during program intake, at an event, or in the course of receiving services, after we have explained these terms;
- or by sending a text message to one of our numbers first.

Consent to receive text messages is never a condition of receiving services, enrolling in a program, volunteering, or making a donation. You can use every part of our website, and receive every service we offer, without agreeing to receive text messages.

15. Message frequency

Message frequency varies depending on the program you are involved with and the conversation you are having with us.

16. Message and data rates

Standard message and data rates may apply. These are charged by your mobile carrier, not by OC United. Carriers are not liable for delayed or undelivered messages.

17. How to stop receiving messages

You can cancel text messages at any time by replying STOP to any message you receive from us. After you reply STOP, we will send one final message confirming that you have been unsubscribed, and you will not receive further text messages from that program unless you sign up again. You can also ask any OC United staff member to remove your number, or email us at info@ocunited.org.

18. How to get help

If you need help or have questions about our text messaging program, reply HELP to any message you receive from us, email us at info@ocunited.org, or call us at 714-515-3085.

19. Your privacy

Your mobile number and the information you send us are handled in accordance with our Privacy Policy, available at https://www.ocunited.org/privacy-policy.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We share mobile numbers only with the messaging service providers that deliver our texts on our behalf, and only for that purpose.

20. Participants under 18

Signing up for text messages through our website is intended for adults 18 and older. Where a program involves a participant under 18, we ask a parent or legal guardian to provide consent for text messaging as part of enrollment, and at least two OC United adults are included in any message thread that includes a minor. A parent or legal guardian may withdraw that consent at any time by contacting us at info@ocunited.org.

[BLOCKER — David and Erin must confirm both statements are current, actual practice before this publishes: that parental consent for text messaging is part of intake paperwork, and that the two-adult rule is followed. A published safeguard that isn't followed is worse than no statement.]

21. Changes to these terms

We may update these terms from time to time. The current version will always be posted on this page with an updated date at the top.
